Dispatch
  1. Orders are usually processed within one business day of them being placed.
  2. If your order cannot be processed within one business day, Latarka will get in touch with you and inform you of the expected time frame for processing and dispatch.
  3. Once your order is processed by our staff you will receive an email with your tracking information, a tax invoice, and your product serial numbers.
Shipping
  1. We ship via Australia Post Express, meaning that you should receive your order within 3 business days of processing and dispatch.
  2. Please note that Latarka will not dispatch goods internationally; Customers must provide an Australian Street or PO Box Address with their order.
  3. Shipping takes place at your own risk. Should you like to offset your risk, on checkout you may choose a shipping method that includes appropriate insurance and signature on delivery.
Tax
  1. All displayed prices include Australian Goods and Services Tax (GST).
General Terms
  1. The following Terms, as well as items noted under ‘Dispatch’ ‘Shipping’ and ‘Tax’ shall apply to business relationships of any kind between Latarka Pty. Ltd. (henceforth referred to as Latarka) and customers of Latarka’s online store.
  2. The product on display in the online store does not constitute a legally binding offer; it is merely an invitation to treat.
  3. By clicking ‘Place Order’, the customer is making a legally binding commitment to purchase the goods in their shopping cart from Latarka.
  4. Latarka reserves the right to refuse to provide the goods purchased by the customer if it becomes apparent the goods are not available despite a corresponding contractual transaction being concluded. In such cases, the customer shall be notified immediately. Any consideration that has already been provided to Latarka under the order shall be reimbursed to the customer without delay.
  5. Prices displayed on the online store are subject to change without notice.
  6. Latarka reserves the right at any time to modify or discontinue goods.
  7. Latarka shall not be liable to the customer or to any third-party for any modification, price change, suspension, or discontinuance of the sale of goods.
Warranty
  1. All goods sold by Latarka are subject to a two (2) year warranty period. This period commences upon the dispatch of goods by Latarka.
  2. Defects or any other damage caused by negligent or improper treatment of the goods, improper installation, the use of unsuitable accessories, operator error, incorrect application of the goods, normal wear and tear, or changes made to the original parts by the customer or a third party not commissioned by Latarka are not covered by warranty.
Payment Terms
  1. Unless otherwise agreed in writing, invoices from Latarka must be paid in full and without delay. Orders will only be shipped to customers upon full receipt of payment.
  2. Latarka reserves the right to decline cheques and other non-cash means of payment.
  3. Any bank fees must be borne by the customer.
Retention of Title
  1. All goods supplied to the customer shall remain the property of Latarka until any and all outstanding claims against the customer, including any existing ancillary receivables, have been paid in full. In the case of contracts already concluded with consumers, Latarka shall reserve the right of retention for the goods until the purchase price has been paid in full.
  2. The customer shall not be entitled to sell the goods to third parties or to take any other measures which could put the ownership of the goods at risk until the purchase price has been paid in full.
Personal Information
  1. The information customers provide to Latarka through their use of the online store will be kept on file by Latarka in accordance with statutory requirements. Should you wish Latarka to cease storing your personal information please email mail@latarka.com.au and put forward this request.
Errors, Inaccuracies & Omissions
  1. Occasionally there may be information on our site that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, dispatch times, and availability. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).
 Indemnification
  1. The customer agrees to indemnify Latarka against any and all injury, loss, cost, claim, demand, expense, or damage suffered to or incurred by Latarka. The Customer will indemnify, defend and hold harmless Latarka and any parents, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees.
Jurisdiction, Revocation, & Severability
  1. The law relating to these Terms shall be the law of the State of New South Wales, Australia.
  2. This Agreement supersedes all prior discussions and writings with respect to purchases made from Latarka’s online store by the customer.
  3. In the event that any provision of these terms is determined to be unlawful, void, or unenforceable, the unlawful, void, or unenforceable portion shall be deemed to be severed, but such severance shall not affect the validity and enforceability of any other remaining provisions.
